In our mobile applications (e.g., Global Mobile Application), we use “software development kits” (SDKs). Information From Other Sources
We may collect information about you from the Nikkos Family, which includes Nikkos Corporation and its affiliates, subsidiaries, franchisees, business partners, and vendors (like food delivery platforms or payment processors), as well as from public sources (such as your public social media posts).

If you’re receiving communications from a Nikkos franchisee, you will need to opt out directly with them.

3.7 თანხის დაბრუნება შესაძლებელია მხოლოდ უნაღდო ანგარიშსწორებით მომხმარებელის იმ საბანკო ანგარიშის ნომერზე თანხის ჩარიცხვის გზით, რომლის მეშვეობითაც  განხორციელდა პროდუქციის შეკვეთა, ხოლო მომხმარებლის მიერ შეკვეთის ღირებულების ნაღდი ანგარიშსწორებით გადახდის შემთხვევაში, თანხის დაბრუნება შესაძლებელია, მომხმარებლის მიერ შესაბამისი ფილიალისათვის მოწოდებულ მის კუთვნილ საბანკო ანგარიშის ნომერზე თანხის ჩარიცხვით

3.8  პროდუქტის ღირებულების დაბრუნება, პროდუქტის შეცვლა წინამდებარე წესების გათვალისწინებით შესაძლებელია, თუ:

3.8.1 პროდუქტი არ შეესაბამება შეკვეთას ან ვებ-გვერდზე განთავსებულ აღწერილობას;

3.8.2 პროდუქტს აქვს აშკარა ნაკლი;

3.8.3 პროდუქტი დაზიანებულია ტრანსპორტირების პროცესში.

3.9 Nikkos მომხმარებლის მიერ შეძენილი პროდუქტის ღირებულების დაბრუნების და პროდუქტის შეცვლის სურვილის შემთხვევაში,  წინამდებარე შეთანხმების 3.8 და 3.3 პუნქტების მოთხოვნათა გათვალისწინებით, იღებს ვალდებულებას: 

3.9.1 მომხმარებელს სრულად დაუბრუნოს შეკვეთილი პროდუქტის ღირებულება, თუკი მთლიანი შეკვეთა ნაკლის მქონეა მყიდველისგან დამოუკიდებელი მიზეზებით.

3.9.2 მომხმარებელს ხელახლა გაუგზავნოს მთლიანი შეკვეთა, მასთან წინასწარ შეთანხმებულ დროში, იმ შემთხვევაში, თუკი მთლიანი შეკვეთა ნაკლის მქონეა მყიდველისგან დამოუკიდებელი მიზეზებით. 

3.9.3 მომხმარებელს დაუბრუნოს შეკვეთაში დანაკლისი პროდუქტის ღირებულება, თუკი შეკვეთას აკლია გარკვეული სახეობის/რაოდენობის პროდუქცია.

3.9.4 მომხმარებელს ხელახლა გაუგზავნოს შეკვეთაში დანაკლისი პროდუქტი, მასთან წინასწარ შეთანხმებულ დროში, თუკი შეკვეთას აკლია გარკვეული სახეობის/რაოდენობის პროდუქცია.

3.10 Nikkos მომხმარებელს შეძენილი პროდუქციის ღირებულებას, წინამდებარე შეთანხმებით დადგენილი წესითა და ოდენობით აუნაზღაურებს არაუმეტეს 7 (შვიდი) სამუშაო დღის ვადაში.

3.11 მყიდველის მიერ წინამდებარე პოლიტიკით გათვალისწინებული სათანადო დასაბუთებით პროდუქციის შეცვლის მოთხოვნის შემთხვევაში, მიტანისთანავე მყისიერად მოხდება მყიდველის მხრიდან შემთხვევის დაფიქსირება იმ ფილიალში, საიდანაც მოხდა შეკვეთის განხორციელება, ხოლო ფილიალის მიერ, მომხმარებლის გაცხადებული პრეტენზიის დადასტურების  შემდეგ, აგრეგატორებს ამ ფილიალიდან  მიეცემათ  დასტური მომხმარებლისათვის პროდუქციის ხელახალ მიწოდებაზე.

მუხლი 4. შემადგენლობა/კონტენტი
ნებისმიერი ვიზუალური და ტექსტური მასალა, რომელიც განთავსებულია ჩვენს ვებ-გვერდზე, წარმოადგენს  Nikkos-ის საკუთრებას ან აქვს გამოყენების ნებართვა. თქვენ არ გაქვთ უფლება გაავრცელოთ, შევცვალოთ, გადაუგზავნოთ, გადმოწეროთ, დააკოპიროთ ან გამოიყენოთ აღნიშნული კონტენტი სრულად ან ნაწილობრივ პირადი კომერციული მიზნებისთვის ან წინასწარ წერილობითი ნებართვის მიღების გარეშე.

მუხლის 5. აკრძალული გამოყენება
თქვენ შეგიძლიათ გამოიყენოთ სერვისი მხოლოდ კანონიერი მიზნებით და პირობების შესაბამისად.

მუხლი 6. ანალიტიკა
ჩვენ შესაძლოა გამოვიყენოთ მესამე მხარის მომსახურება, ჩვენი სერვისის გამოყენების მონიტორინგისა და ანალიზისთვის.

მუხლი 7. ანგარიშები
როდესაც თქვენ ქმნით ანგარიშს ჩვენს ვებ-გვერდზე, თქვენ ადასტურებთ, რომ თქვენს მიერ მოწოდებული ინფორმაცია ზუსტი, სრულყოფილი და აქტუალურია ნებისმიერი დროისთვის. არასწორმა, არასრულმა ან მოძველებულმა ინფორმაციამ შესაძლოა გამოიწვიოს თქვენი ანგარიშის დაუყოვნებლივი გაუქმება.
თქვენ ხართ პასუხისმგებელი თქვენი ანგარიშისა და პაროლის კონფიდენციალურობის შენარჩუნებაზე. თქვენ ეთანხმებით პასუხისმგებლობის აღებას თქვენს ანგარიშთან ან/და პაროლთან დაკავშირებულ ნებისმიერ და ყველა აქტივობასა თუ ქმედებაზე. თქვენ დაუყოვნებლივ უნდა გვაცნობოთ თქვენი ინფორმაცია უსაფრთხოების დარღვევის ან თქვენი ანგარიშის უნებართვოდ გამოყენების შესახებ.
ჩვენ ვიტოვებთ უფლებას უარი ვთქვათ მომსახურებაზე, შევადგინოთ ანგარიშები, ამოვიღოთ ან შევცვალოთ შინაარსი, ან შევაჩეროთ შეკვეთები ჩვენი შეხედულებისამებრ.

მუხლი 8. შეწყვეტა
ჩვენ შეგვიძლია შევწყვიტოთ ან შევაჩეროთ თქვენი ანგარიში და სერვისზე წვდომა დაუყოვნებლივ, წინასწარი შეტყობინების გარეშე ან პასუხისმგებლობის გარეშე, ჩვენი შეხედულებისამებრ, რაიმე მიზეზის გამო და შეზღუდვის გარეშე, მათ შორის, მაგრამ არ მხოლოდ პირობების დარღვევის შემთხვევაში.
თუ გსურთ ანგარიშის შეწყვეტა, შეგიძლიათ უბრალოდ შეწყვიტოთ მისი გამოყენება ან თავად წაშალოთ თქვენი ანგარიში.

 მუხლი 9. მარეგულირებელი კანონი
წესები და პირობები რეგულირდება და ინტერპრეტაცია ხორციელდება საქართველოს კანონმდებლობის შესაბამისად, შესაბამისი მარეგულირებელი კანონის ფარგლებში, მასთან კონფლიქტში მყოფი დებულებების გათვალისწინების გარეშე.
ჩვენს მიერ ამ პირობების რაიმე უფლების ან დებულებების შეუსრულებლობა, არ განიხილება ამ უფლებების უგულებელყოფად. თუ ამ პირობების რომელიმე დებულება სასამართლოს მიერ ბათილად ან კანონიერი ძალის არმქონედ ჩაითვლება, ამ პირობების დარჩენილი დებულებები რჩება მოქმედად.

მუხლი 10. ცვლილებები სერვისში
ჩვენ ვიტოვებთ უფლებას, შევიტანოთ ცვლილებები ჩვენს მომსახურებაში, ჩვენი შეხედულებისამებრ. პერიოდულად, ჩვენ შეიძლება შევზღუდოთ წვდომა მომსახურების ზოგიერთ ნაწილზე ან მთლიან სერვისზე, მომხმარებლებზე, მათ შორის რეგისტრირებულ მომხმარებლებზე. 

მუხლი 11. დასტური/თანხმობა
ჩვენი სერვისით ან ჩვენს მიერ მოწოდებული სხვა სერვისის გამოყენებით, ადასტურებთ, რომ წაიკითხეთ და გაეცანით ამ წესებსა და პირობებს და ეთანხმებით მათ.

გთხოვთ, თქვენი გამოხმაურება, კომენტარები, ტექნიკური დახმარების მოთხოვნა გამოაგზავნოთ ელ. ფოსტაზე: [email protected]. 

მუხლი 13. შეკვეთის მიწოდების პოლიტიკა

13.1 თუ მყიდველი Nikkos-ის მომსახურების საშუალებით ითხოვს შეკვეთის მიწოდებას, შეკვეთა მიწოდებული იქნება იმ მისამართზე, რომელიც მითითებულია მყიდველის მიერ https://nikkos,site -ის ვებგვერდზე ან Nikkos-ის აპლიკაციაში.

13.2. მყიდველი ვალდებულია შეეძლოს ზარების მიღება იმ ტელეფონის ნომერზე, რომელიც მან მიუთითა შეკვეთის მომენტში  Nikkos-ის ვებ გვერდზე  https://nikkos.site. თუ მყიდველის მიერ მითითებულ ტელეფონის ნომერზე ვერ მოხდება დაკავშირება, მიწოდება შეიძლება გაუქმდეს  Nikkos-ის მიერ და მყიდველს შესაძლოა დაეკისროს შეკვეთის სრული ღირებულების გადახდა.

13.3. მყიდველს შეუძლია მიუთითოს, რომ შეკვეთის მიწოდება მოხდეს რაც შეიძლება სწრაფად (მიწოდების სტანდარტული მეთოდი) ან წინასწარ შეუკვეთოს და მიუთითოს მიწოდების კონკრეტული დრო ან შეუკვეთოს და თავად მივიდეს შეკვეთის ასაღებად წინასწარ განსაზღვრულ დროს.

13.4. მიწოდების სტანდარტული მეთოდი: მყიდველი ვალდებულია იმყოფებოდეს შეკვეთაში მითითებულ მიწოდების მისამართზე შეკვეთის გაკეთებიდან იმ დრომდე, სანამ შეკვეთაში მითითებულ პროდუქციას ჩაიბარებს. თუ მყიდველი არ იმყოფება მის მიერ მითითებულ ადგილზე შეკვეთილი პროდუქციის მიწოდებიდან 10 (ათი) წუთის განმავლობაში და მყიდველთან დაკავშირება ვერ ხერხდება მიმწოდებელი კურიერის მიერ დაკავშირების ორი მცდელობის შემდეგ, მიწოდებ გაუქმდება  და თანხა სრულად რჩება Nikkos-ის.

13.5. წინასწარი შეკვეთის მიწოდება: იმისათვის, რომ მიიღოს შეკვეთა, მყიდველი უნდა იმყოფებოდეს მითითებულ მისამართზე დროის მონაკვეთში, რომელიც იწყება წინასწარი შეკვეთის მიწოდების დრომდე ათი წუთით ადრე და მთავრდება მიწოდების მომენტში.

13.6. მიწოდების დრო-შეძენილი პროდუქციის მიწოდების განხორციელების ან ნებისმიერი სხვა დრო, რომელიც ეცნობება მყიდველს  Nikkos-ის მომსახურების საშუალებით არის მხოლოდ სავარაუდო დრო. არ არსებობს გარანტია იმისა, რომ შეკვეთა მიწოდებული იქნება განსაზღვრულ დროს. პროდუქციის მიწოდების დროზე გავლენა შეიძლება მოახდინოს ისეთმა ფაქტორებმა, როგორებიცაა საგზაო საცობები, პიკის საათები და ამინდი.

13.7 მიწოდების ფასი მოცემულია შეკვეთის დასრულების გვერდზე. მიწოდების ღირებულება დამოკიდებულია, შეკვეთის მოცულობაზე, მიწოდების მანძილზე, საგზაო საცობებზე, პიკის საათზე და ამინდზე.

მუხლი 14. შესვლის მონაცემები
ჩვენ გატყობინებთ, რომ ვებგვერდზე შესვლისას, ჩვენ ვაგროვებთ ინფორმაციას, რომელსაც აგზავნის თქვენი ბრაუზერი და მას ეწოდება შესვლის მონაცემები. ეს შეიძლება მოიცავდეს ისეთ ინფორმაციას, როგორიც არის თქვენი კომპიუტერის ინტერნეტ პროტოკოლის მისამართი, ბრაუზერის ვერსია, ჩვენი საიტის მონახულებული გვერდები, ამ გვერდებზე გატარებული დრო და სხვა სტატისტიკა.
   
მუხლი 15. სხვა ვებგვერდის ბმულები
ჩვენი ვებგვერდი შეიძლება მოიცავდეს ბმულებს სხვა გვერდებზე გადასასვლელად. თუ თქვენ გამოიყენებთ მსგავს ბმულს, თქვენ გადამისამართდებით შესაბამის გვერდზე. დაიმახსოვრეთ, რომ მათი ფუნქციონირება არ გვეხება ჩვენ, ამიტომ გთხოვთ, გადახედოთ მათი კონფიდენციალურობის პოლიტიკას. ჩვენ ვერ ვახორციელებთ კონტროლს და შესაბამისად პასუხს არ ვაგებთ სხვისი ვებგვერდის შემადგენლობასა, პოლისებსა და პრაქტიკაზე.
